By subscribing to Perch ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Perch is a subscription-based email alert service that aggregates apartment listings from third-party websites including Craigslist, Zillow, and StreetEasy and delivers daily email digests to subscribers based on user-defined criteria. The Service is intended for personal, non-commercial use.
All apartment listings delivered through the Service are sourced from publicly available third-party websites. Perch does not create, verify, or guarantee the accuracy, completeness, or availability of any listing. Listings may be outdated, inaccurate, or removed from the source site at any time without notice. Perch is not a licensed real estate broker and does not facilitate or participate in any rental transaction. You are solely responsible for independently verifying any listing before making any rental decision.
The Service is offered on a monthly subscription basis at $10/month (USD). New subscribers receive a 3-day free trial. You will not be charged until the free trial expires. Subscriptions automatically renew monthly until cancelled. You may cancel at any time from your account management page and your subscription will remain active until the end of the current billing period. No refunds are issued for partial months. Payments are processed securely by Stripe.
You agree to (a) provide accurate information when creating your account; (b) not use the Service for any commercial purpose or to create derivative products; (c) not attempt to scrape, reverse-engineer, or circumvent any aspect of the Service; and (d) comply with all applicable laws and the terms of service of any third-party sites from which listings originate.
By subscribing, you consent to receive the daily apartment digest emails that are the core functionality of the Service, as well as transactional emails (e.g., payment confirmations, subscription updates). Every email we send includes: (a) our physical or electronic address; (b) a clear way to opt out or cancel. To stop receiving emails, cancel your subscription at any time from the manage page. Cancellation requests are processed immediately. We do not sell or share your email address with third parties for marketing purposes.
The Perch brand, website, and application code are the exclusive property of Perch. Listing data remains the property of the respective third-party platforms from which it is sourced. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal purposes only.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY LISTING INFORMATION WILL BE ACCURATE OR CURRENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING ANY RENTAL DECISIONS MADE BASED ON LISTINGS DELIVERED THROUGH THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. We will notify subscribers of material changes by email. Continued use of the Service after changes constitutes acceptance of the new terms.
